Acceptance of Terms
By downloading, installing, or using the FineTime mobile application or any associated website (collectively, "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms constitute a legally binding agreement between you and FineTime Ltd ("FineTime", "we", "us", or "our"), a company registered in England and Wales.
Your continued use of the Service following any modification to these Terms constitutes your acceptance of the revised Terms. We will notify you of material changes where we are able to do so.
Age & Eligibility
By creating an account, you represent and warrant that:
- You are at least 18 years of age, or the minimum legal drinking age in your jurisdiction, whichever is higher.
- You have the legal capacity to enter into a binding agreement.
- You are not prohibited from using the Service under applicable law.
- You will not use the Service to facilitate underage drinking in any way.
The Service
FineTime provides a mobile application that enables groups of users to file humorous peer-reviewed charges against one another, conduct group votes on those charges, and record outcomes for entertainment purposes.
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice. We will not be liable to you for any modification, suspension, or discontinuation.
Your Account
To use the Service you must register for an account using a valid email address. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.
You agree to notify us immediately at our contact page if you become aware of any unauthorised use of your account. We are not liable for any loss resulting from unauthorised use of your account that occurs without our fault.
You agree to provide accurate, current, and complete information when registering and to keep that information up to date. Accounts using false information may be terminated.
You may request deletion of your account at any time via the contact page. Upon deletion, your personal data will be removed in accordance with our Privacy Policy, subject to any retention obligations under applicable law. Charges and votes in which you participated may be anonymised rather than deleted where removal would affect other users' legitimate records.
Acceptable Use
FineTime is built for friends having fun. The following uses are expressly prohibited and may result in account termination and, where appropriate, referral to the relevant authorities.
Your Content
The Service allows you to submit charges, votes, comments, and other content ("User Content"). You retain ownership of the content you create. By submitting User Content, you grant FineTime a non-exclusive, royalty-free, worldwide licence to store, display, and transmit that content solely for the purpose of operating and improving the Service.
You represent and warrant that:
- You own or have the necessary rights to submit the content.
- The content does not violate these Terms, any applicable law, or any third party's rights.
- The content does not contain private information about any individual who has not consented to its publication.
We reserve the right to remove any User Content that violates these Terms, without notice and without liability to you.
If you believe content on the platform violates these Terms, please report it via the in-app reporting tool or through our contact page. We review all reports and act where appropriate.
Privacy & Data
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains how we collect, use, and protect your personal data.
By using the Service, you acknowledge that FineTime will process your personal data in accordance with the Privacy Policy and in compliance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
Secret ballot votes are never attributed to individual users in any logs, displays, or data exports. The integrity of the jury's deliberations is maintained.
Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components. We do not warrant that any verdict, sentence, or outcome within the Service accurately reflects the views of any individual user.
Limitation of Liability
To the fullest extent permitted by law, FineTime Ltd, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
This includes, without limitation:
- Damage to relationships, however charged the group chat becomes.
- Loss arising from reliance on any verdict or sentence generated by the Service.
- Loss of data arising from account deletion or technical failure.
- Harm resulting from User Content submitted by other users.
Our total aggregate liability to you for any claim arising under these Terms shall not exceed the greater of £50 or the amount you have paid to us in the twelve months preceding the claim. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.
Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms or if we are required to do so by law.
You may terminate your account at any time by submitting a deletion request via the contact page. Termination does not affect any rights or obligations that arose prior to termination.
Upon termination, your right to access the Service ceases immediately. Sections of these Terms that by their nature should survive termination — including Sections 6, 8, 9, and 12 — shall survive.
Changes to These Terms
We may update these Terms from time to time. We will indicate the effective date of the current version at the top of this page. Where the changes are material, we will endeavour to notify you via the app or by email before they take effect.
Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service.
Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
